What role, if any, should the government perform in a society? Two very different answers to this question have been provided by John Rawls and Robert Nozick. In this article, we analyze the grammatical incorporation of demonstratives in a tactile language, emerging in communities of DeafBlind signers in the US who communicate via reciprocal, tactile channels—a practice known as “protactile.” In the first part of the paper, we report on a synchronic analysis of recent data, identifying four types of “taps,” which have taken on different functions in protacitle language and communication. In the second part of the paper, we report on a diachronic analysis of data collected (...) over the past 8 years. This analysis reveals the emergence of a new kind of “propriotactic” tap, which has been co-opted by the emerging phonological system of protactile language. We link the emergence of this unit to both demonstrative taps, and backchanneling taps, both of which emerged earlier. We show how these forms are all undergirded by an attention-modulation function, more or less backgrounded, and operating across different semiotic systems. In doing so, we contribute not only to what is known about demonstratives in tactile languages, but also to what is known about the role of demonstratives in the emergence of new languages. (shrink)

Based on responses from 1078 human resource (HR) professionals, this study concludes that there is not an ethical crisis in the work place. Seven of 37 situations were rated as serious problems by more than 25% of the respondents. HR reported that their organizations are serious about uncovering and disciplining ethical misconduct, top management has a commitment to ethical business conduct, personal principles are not compromised to conform to company expectations, and performance pressures do not lead to unethical conduct.

The practice of prenatal screening for disability is sometimes objected to because of the hurt and offence such practices may cause to people currently living with disabilities. This objection is commonly termed “the expressivist objection”. In response to the objection it is standardly claimed that disabilities are analogous to illnesses. And just as it would be implausible to suppose reduction of the incidence of illnesses such as flu sends a negative message to ill people, so it is not plausible to (...) suppose prevention of disability sends a negative message to disabled people. The expressivist objection hinges, however, upon a view of the relationship between disability and self identity which sees disability as part of the identity of the disabled person, in a way in which illnesses such as flu cannot be. This possibility is generally not considered in critiques of the expressivist objection. In this paper, an “identity claim” to the effect that disabilities can be identity constituting is accepted and the force of the expressivist argument is reconsidered in the light of its acceptance. It is concluded that even when such an identity claim is accepted, the expressivist objection is still not morally compelling. (shrink)

In his classic 1936 paper Tarski sought to motivate his definition of logical consequence by appeal to the inference form: P(0), P(1), . . ., P(n), . . . therefore ∀nP(n). This is prima facie puzzling because these inferences are seemingly first-order and Tarski knew that Gödel had shown first-order proof methods to be complete, and because ∀nP(n) is not a logical consequence of P(0), P(1), . . ., P(n), . . . by Taski's proposed definition. An attempt to resolve (...) the puzzle due to Etchemendy is considered and rejected. A second attempt due to Gómez-Torrente is accepted as far as it goes, but it is argued that it raises a further puzzle of its own: it takes the plausibility of Tarski's claim that his definition captures our common concept of logical consequence to depend upon our common concept being a reductive conception. A further interpretation of what Tarski had in mind when he offered the example is proposed, using materials well known to Tarski at the time. It is argued that this interpretation makes the motivating example independent of reductive definitions which take natural numbers to be higher-order set theoretic entities, and it also explains why he did not regard the distinction between defined and primitive terms as pressing, as was the distinction between logical and nonlogical terms. Despite achieving broad acceptance of the moral case for treating animals fairly, the animal rights movement has reached an impasse concerning legal rights for animals. Zoopolis proposes a new approach to addressing this failure: integrating animal interests into human society via political institutions and practices. Zoopolis’s central theory that humans owe animals citizenship rights in a shared human-animal society, but that acceptance of responsibilities by animals also is required, has merit for the advancement of animal rights discourse. But its anthropocentric (...) approach, which itself exerts power over animals, necessitating suppression and policing of animals’ natural behavior, is problematic. (shrink)

In the years 2020–2021, journalists, lawyers, scholars, and civil society actors noticed an unusual spike in the refusal of francophone African immigrants in Québec, Canada. While Immigration, refugee and citizenship Canada’s systemic racism problem were already documented, the novelty appeared to be how standardized and sometimes, “nonsensical” the reasons given to many of the applicants were. This eventually prompted a lawsuit against IRCC in which it was revealed that a new piece of software called “Chinook” had been deployed since 2018, (...) approximately at the same time application refusal started spiking. Online and media-fueled speculations culminated in a broad debate about whether Chinook was an artificial intelligence-based technology. Such controversy, for instance, unfolded during parliamentary consultations in which it was finally disclosed that Chinook was not AI per se., but more of a half-baked automated interface. The present article aims to understand how the performative ambiguity of Chinook informs on the progressive becoming of the Canadian Federal state and its immigration control practices in the current Machine Learning hype. Furthermore, it seeks to understand how the interlacing of public–private partnership, in which the private sector is mobilized to produce AI-driven technology, recursively transforms the exercise of governance and governmentality. We argue, through the Chinook controversy and its unfolding, that there is a shift occurring where AI becomes ever more central in statecraft “anarchitecture” and cybernetic adaptability. (shrink)

In this paper the authors argue that research ethics committees should not be paternalistic by rejecting research that poses risk to people competent to decide for themselves. However it is important they help to ensure valid consent is sought from potential recruits and protect vulnerable people who cannot look after their own best interests. The authors first describe the tragic deaths of Jesse Gelsinger and Ellen Roche. They then discuss the following claims to support their case: competent individuals are epistemologically (...) and ethically in the best position to say which risks are reasonable for them, so RECs should be no more restrictive than the “normal” constraints on people taking risks with themselves; RECs do not judge individual competence ; individual liberty is mostly limited by what serves the public interest, and RECs do not determine public interest; RECs may have a paternalistic role in preventing exploitation of competent people vulnerable to the use of incentives, and in protecting the interests of incompetent people; however, the moral and political authority of RECs has not been established in this respect. An almost unbelievable amount of false philosophy has arisen through not realizing what ‘existence’ means…. [It] rests upon the notion that existence is, so to speak, a property that you can attribute to things, and that the things that exist have the property of existence and the things that do not exist do not. That is rubbish . I have dared to puncture several metaphysical balloons and nothing came out of them but hot air.

One of the many ways that ‘deflationary’ and ‘inflationary’ theories of truth are said to differ is in their attitude towards truth qua property. This difference used to be very easy to delineate, with deflationists denying, and inflationists asserting, that truth is a property, but more recently the debate has become a lot more complicated, owing primarily to the fact that many contemporary deflationists often do allow for truth to be considered a property. Anxious to avoid inflation, however, these deflationists (...) are at pains to point out that the truth property, on their view, is not a property of any significant interest. Correspondingly, inflationists have seen this as an opportunity to refine what kind of property they think truth is, which—according to them—moves their views beyond deflationism. The upshot of this is that there are number of different accounts in the literature of what distinguishes an inflationary truth property from a deflationary one, or—as it is sometimes put—what distinguishes a ‘substantive’ property from an ‘insubstantive’ one. This has made it hard to pin down exactly what is at issue at the metaphysical level between deflationists and inflationists, which makes it increasingly hard to see how debates between them are properly phrased. Given that these positions represent the two central attitudes towards truth in contemporary debates, this makes for a serious obstacle for the project of discerning the correct theory of truth. The aim of this paper is to discern the best way to distinguish between substantive and insubstantive properties, and thus to restore some focus to these debates. I argue that the three central distinctions in the literature fail, and offer what I take to be a more promising distinction in terms of a graded distinction between abundant and sparse properties. In explaining this background, he targets the widely held assumption that the history of modern philosophy can best be understood in terms of a fundamentally unified conception of the subject and subjectivity that unfolds inevitably from Descartes and culminates in twentieth-century phenomenology and existentialism. Those who share this assumption fail to recognize the significance of what Husserl (in the Crisis of European Sciences) called the "paradox of subjectivity," which derives from the necessity of understanding the knowing subject both as a subject for the world and as an object in the world.The origins of contemporary interpretations of the metaphysics of the subject are found primarily in Heidegger's thought. Carr thus devotes the first chapter of this study to the critical assessment of Heidegger's view of modern metaphysics starting with Descartes. For Heidegger, Descartes took over the dominant concept of substance from traditional ontology and transferred it to the human subject. The Cartesian subject, then, was revealed as an underlying hypokeimenon that absorbs or overpowers the world by reducing it to the representational contents of the thinking thing. Moreover, Heidegger maintained that modern thinkers did not go beyond the reductive conception of subjectivity intrinsic to the Cartesian metaphysics of substance. This Heideggerian judgment applies to the major modern thinkers. Even Kant and Husserl figure as representatives of a tradition in which "the knowing subject takes the role of substance; everything is reduced to first properties, whether as immanent in consciousness, object for the subject, or, as in transcendental philosophy, construct and product of subjective activity" (Carr, 31).In chapters 2-4, Carr argues that the Heideggerian interpretation is inadequate with respect to Kant and Husserl. In supporting this position, Carr emphasizes the close affinities between Kant's and Husserl's conceptions of objectivity for consciousness and between their portrayals of subject and self. Wakefield's contribution more directly engages with, and challenges, my claims, and so I focus on (...) addressing his concerns.ClarificationsWakefield correctly notes that I am interested in how mental illness (and illness generally) operates to remove moral responsibility for one's actions. Despite this, it seems at several points that he and I are talking about two different, albeit related, concepts of mental illness. 'Mental illness' is used to both explain and excuse certain behaviors, but these two functions, explanatory and exculpable, do not always operate simultaneously. As we discover biological explanations for apparently immoral behaviors, the question arises as to whether the explanation should remove the immorality and liability for punishment. The 'sick role' can be divided into two aspects. One is the role of deserving and warranting medical treatment. The other is the negation of moral responsibility. Wakefield's own example, pedophilia, involves the first sense of the sick role but not the second. Wakefield's use of this example is unusual, because it deftly highlights the limitation of his HD account. Pedophilia is a mental disorder in the sense of warranting treatment, and is a mental illness under Wakefield's model, but it is not something that negates moral responsibility. There is a sense of the term 'mental illness'—an important and, as I argue, an objective sense—that is relevant to establishing one's moral responsibility for such behaviors.In addressing my account of mental illness as though it contained two distinct answers, 'mental illness as dysfunction of rational agency, or 'mental illness as moral judgment,' it is unclear whether Wakefield takes them to be conjunctive or alternative. Alethic pluralism, on one version of the view , is the idea that truth is to be identified with different properties in different domains of discourse. 1 Whilst we operate with a univocal concept of truth, and a uniform truth predicate, the thought is that the truth property changes from one domain to the next. So the truth property for talk about the nature and state of the material world may be different from the truth property for moral discourse .Tappolet (...) challenged alethic pluralism by asking how it can account for the truth of mixed compounds, such as a mixed conjunction like ‘this cat is wet and funny’, where each of the conjuncts are from different domains of discourse, and thus assessable in terms of different truth properties. She argues that the alethic pluralist is left in a dilemma: either admit of a ‘generic’ truth property, which can be possessed by propositions from all domains, thus rendering the plural ways of being true obsolete, or deny the truth of mixed conjunctions.In Edwards 2008, I argued that there is route out of Tappolet's dilemma. Briefly, I suggested that we acknowledge that the truth of a mixed conjunction is dependent on the truth of its conjuncts, and we should explain the truth of the conjunction by saying that it is true just in case each of its conjuncts is true. ABSTRACT Many people argue that disagreements and inconsistencies between Research Ethics Committees are morally problematic and there has been much effort to ‘harmonise’ their judgements. Some inconsistencies are bad because they are due to irrationality, or carelessness, or the operation of conflicting interests, and so should be reduced or removed. Other inconsistencies, we argue, are not bad and should be left or even encouraged. In this paper we examine three arguments to reject the view that we should strive for complete (...) consistency between committees. The first argument is that differences in judgement are not necessarily incompatible with ideas of justice for patients who are potential participants of research reviewed by different committees. We call this ‘the justice argument.’ The second argument is that such committees do not have access to a single moral truth, to which their judgement is supposed to correspond. We call this the ‘moral pluralism argument.’ The third argument is that the process of ethics committee review is also morally relevant and not solely the outcome. We call this the ‘due process argument.’ While we fall short of establishing exactly how much variation and on what substantive issues would be ethically permissible, we show that it is largely inevitable and that a certain amount of variation could be seen as a desirable part of the institution of medical research. ’Death’ and ’Furniture’ are emblems for two very common (predictable, even) objections to relativism. When relativists talk about the social construction of reality, truth, cognition, scientific knowledge, technical capacity, social structure and so on, their realist opponents sooner or later start hitting the furniture, invoking the Holocaust, talking about rocks, guns, killings, human misery, tables and chairs. The force of these objections is to introduce a bottom line, a bedrock of reality that places limits on what may be treated as (...) epistemologically constructed or deconstructible. There are two related kinds of moves: Furniture (tables, rocks, stones, etc. - the reality that cannot be denied) and Death (misery, genocide, poverty, power - the reality that should not be denied). Our aim is to show how these ’but surely not this’ gestures and arguments work, how they trade off each other, and how unconvincing they are, on examination, as refutations of relativism. (shrink)

The book provides a practical guide to the application of Critical Realism (CR), an increasingly popular philosophy of social science, in empirical research projects. Each purpose-written chapter reviews major social science research methods and contains extended illustration of how to conduct inquiry using CR.

In this article we examine ethical aspects of the involvement of children in clinical research, specifically those who are incapable of giving informed consent to participate. The topic is, of course, not a new one in medical ethics but there are some tensions in current guidelines that, in our view, need to be made explicit and which need to be responded to by the relevant official bodies. In particular, we focus on tensions between the World Medical Association Declaration of Helsinki, (...) and the guidance offered by the British Medical Association, the Royal College of Paediatrics and Child Health , and the Council for International Organizations of Medical Sciences. We conclude with a call for these organisations to make their guidance explicit in relation to the World Medical Association Declaration. (shrink)

Clinical research under the usual regulatory constraints may be difficult or even impossible in a public health emergency. Regulators must seek to strike a good balance in granting as wide therapeutic access to new drugs as possible at the same time as gathering sound evidence of safety and effectiveness. To inform current policy, I reexamine the philosophical rationale for restricting new medicines to clinical trials, at any stage and for any population of patients (which resides in the precautionary principle), to (...) show that its objective to protect public health, now or in the future, could soon be defeated in a pandemic. Providing wider therapeutic access and coordinating observations and natural experiments, including service delivery by cluster (wedged cluster trials), may provide such a balance. However, there are important questions of fairness to resolve before any such research can proceed. (shrink)

This paper examines one particular justification for the screening and termination of embryos/fetuses which possess genetic features known to cause disability. The particular case is that put forward in several places by John Harris. He argues that the obligation to prevent needless suffering justifies the prevention of the births of disabled neonates. The paper begins by rehearsing Harris's case. Then, drawing upon claims advanced in a recent paper in the Journal of Medical Ethics, it is subjected to critical scrutiny, focusing (...) on Harris's “suffering claim” .1 It is argued that the suffering claim must be false if understood as an empirical claim. And, even if understood as a conceptual truth, it mistakenly assimilates the concepts of harm and suffering. Finally, again focusing on Harris's recent work in this area, his characterisation of disability as a “harmed condition” is shown not to apply in the case of at least some moderate forms of intellectual disability. This article asks: Is the human self, the stream of human consciousness, a single unique enduring actual entity or whole (like Alfred North Whitehead’s God) or a society of transient actual occasions (like Charles Hartshorne’s God)? It argues forcefully for the former and against the latter and concludes that both God and human selves are enduring but constantly developing actual entities who are constantly being enriched by new events, experiences, and activities in time.

Jansen and Wall suggest a new way of defending hard paternalism in clinical research. They argue that non-therapeutic research exposing people to more than minimal risk should be banned on egalitarian grounds: in preventing poor decision-makers from making bad decisions, we will promote equality of welfare. We argue that their proposal is flawed for four reasons.First, the idea of poor decision-makers is much more problematic than Jansen and Wall allow. Second, pace Jansen and Wall, it may be practicable for regulators (...) to uncover the values that a potential research participant holds when agreeing to enter a research project, so their claim that we must ban such research projects for all if we are to ban them for poor decision-makers looks to be unmotivated. Third, there seem to be cases where the liberty to enter the sort of research project Jansen and Wall discuss is morally weighty, and arguably should outweigh concerns of egalitarian distribution.
